Scholars have disagreed over confirmation of divorce in the case of aman uttering divorce amusingly. The majority of schools (Jumhour Al-Ulama) believe it's confirmed; others believe it is not. This study shows that what is supported by evidence and conforms to laws (Shari'ah) intent and legislator's wisdom is the second opinion, i.e. divorce is not confirmed and is reliable, though the husband is urged to avoid uttering this divorce in deference to his wife's feelings and sustaining of intimacy. اختلف العلماء في وقوع طلاق الرجل على زوجته إذا تلفظ به هازلاً، فذهب جمهورهم إلى أنّه يقع، وذهب آخرون إلى عدم وقوعه، وقد تبيّن من هذه الدراسة أن الذي تنصره الأدلة ويتفق مع مقاصد الشريعة وحكمة المشرع؛ هو القول بعدم وقوع الطلاق من الهازل، وعدم الاعتداد به، وإن كان الزوج منهياً عن ذلك مراعاة لمشاعر زوجته، وقياماً بحسن العشرة
